Summary
Our law firm is seeking to hire an immigration attorney who will be an exceptional addition to our team. As an immigration associate attorney, you will be responsible for managing a caseload of removal (deportation) defense, family-based & humanitarian immigration cases. You will represent clients, many of whom are detained by ICE, in their immigration court cases, and also in their appeals. You will bring a number of skills to this job, including (a) strong written and oral advocacy; (b) effective client and caseload management; (c) disciplined adherence to best practices; and (d) commitment to exercising leadership and improving the performance of our team.
What You'll Do
Manage a caseload of removal defense cases in the Phoenix, Florence, and Eloy Immigration Courts, in addition to managing a caseload of affirmative applications pending before USCIS and the Department of State.
Prepare and litigate applications for relief from removal, including cancellation of removal, adjustment of status, asylum, withholding of removal, Convention Against Torture (CAT), and other waivers
Prepare and argue motions to release our clients from detention in bond proceedings
Challenge allegations of removability through motions to terminate and motions to suppress
Conduct investigations and discovery to effectively support our client's claims with persuasive evidence
Work closely with clients and their families to prepare affirmative applications for visas, citizenship, asylum, U visas, T visas, and visas under the Violence Against Women Act (VAWA), in addition to waiver of inadmissibility
Effectively communicate with other attorneys and experts in the field-locally and nationally-to leverage as much knowledge and advice as possible for the benefit of our clients
Legal research and writing--specifically, drafting and filing motions and briefs before the immigration courts, Board of Immigration Appeals (BIA), and U.S. Court of Appeals for the Ninth Circuit
Analyze the immigration consequences of criminal convictions by providing “Padilla consults” to criminal defense attorneys
Litigate petitions for writ of habeas corpus and applications for preliminary injunctive relief in the U.S. District Court
Perform consultations for potential clients who are interested in the law firm's services

The Organization
The position involves representation of individuals detained in the Florence and Eloy detention centers, and in some cases continuing representation once released in Arizona. The Interim Managing Attorney will supervise the legal work of Senior Attorneys, Staff Attorneys, DOJ Accredited Representative and legal assistants in the projects mentioned below, mentor legal staff, provide legal representation to detained immigrants, and provide legal trainings to the community. The Interim Managing Attorney will also collaborate on training and professional development initiatives for legal staff and participate with program development and outreach activities, in conjunction with the managing team, Associate Legal Program Manager, Adult Legal Program Manager, Deputy Director, and Executive Director. This position reports to the Associate Legal Program Manager for the Adult Program.
The Direct Representation Team members handle a variety of forms of relief from deportation and bond hearings and represent individuals with cutting edge asylum issues. Additionally, team members provide direct representation to both detained and released individuals in immigration removal proceedings with serious mental health conditions who have been found incompetent to represent themselves.
Essential Duties & Responsibilities
Supervisory Leadership Responsibilities
On a limited basis, provide direct representation to detained individuals in Florence and Eloy and to some released clients where appointed as counsel, with the opportunity to hand-select a small caseload with a focus on cases posing challenging issues or appeals of particular importance. Direct representation will also include second chairing supervised attorneys in a wide variety of deportation defense cases.
Supervise the team's Staff Attorneys, Senior Staff Attorneys, DOJ Accredited Representatives, and Legal Assistants. This includes overseeing and being responsible for the quality of services provided before the courts, conducting case reviews with supervised staff as needed, and providing training, mentorship, and support to the legal staff. The Managing Attorney will work closely with the Program Managers in updating them on supervision and oversight.
Support the implementation of any changes to the scope of legal services provided or the model for delivering those services.
Oversee case review meetings with legal staff and interns, hire new staff, coordinate orientation for new hires in conjunction with other departments, and plan training for legal staff.
When necessary, participate in program development with the Associate Legal Program Manager, Adult Legal Program Manager, Legal Director, Deputy Director, and the Executive Director, including participating in annual strategic planning retreats. Lead the implementation of any changes to the scope of direct representation legal services provided or the model for delivering those services.
Supervise and maintain accurate and timely data and reports that reflect the work completed by the team.
Oversee collection of data by the legal staff for various grant funded positions, complete quarterly reporting for funders, and participate in network calls, meetings, and trainings.
Attract, retain, lead, coach and develop an effective, diverse team of Staff Attorneys, Senior Staff Attorneys, Legal Assistants, Legal Administrative Assistants, Interns, and special project legal fellows, and provide a collegial, calm, and collaborative work environment that is client-centered and ego free.
Develop, monitor, and evaluate staff goals, caseloads, and work plans.
Coach, train, mentor, and support the legal staff to ensure they have the necessary tools and resources needed to optimize performance and achieve established program goals and that effective communication exists among the staff and the team, including establishing and maintaining regular team meetings.
Responsible for working in collaboration with Program Managers regarding hiring, orientation, employee relations, performance management and evaluation of staff.
Oversee criteria and procedures for accepting, opening, managing, and closing case files; formulate legal strategies for cases and designate protocols for the allocation of limited resources.
Support and implement quality assurance protocols; ensure quality of services provided to all stakeholders.
Work with other Managing Attorneys, Program Managers, Deputy Director and administrative staff to ensure that FIRRP's legal practice is in compliance and good standing with all relevant bodies and agencies.
Support Florence Project outreach and development activities as needed.
Casework
Provide direct representation to individuals including challenging casework, appeals, mental health casework, and second chairing cases with new attorneys.
Oversee attorney meetings, periodic joint case reviews, and participate in intake review meetings. Plan legal trainings as needed.
Well-versed, and remain current in immigration law, and on implications of criminal and civil law as it applies to the representation of immigrants and refugees. Establish and implement policies and procedures.
Ensure all staff comply with required ethical standards, preserve client confidentiality, and avoid conflicts of interest.
Advocacy
Attend occasional meetings and communications with Acacia Center for Justice, EOIR, ICE officials, and/or detention center officials to discuss ongoing issues.
Communicate with the Legal Director and Advocacy program about possible advocacy initiatives and legal trainings for the community.
Other Duties & Responsibilities:
Participate in organizational fundraising and outreach efforts as requested.
Participate in developing and implementing special projects or presentations.

Minimum Requirements:
J.D. and licensed to practice law in any state or jurisdiction

Preferred Requirements:
2+ years of minimum experience providing direct representation to immigrants' removal proceedings, and extensive knowledge of immigration law, specifically deportation defense, asylum, and criminal-immigration law issues is strongly preferred.
Prior advocacy work in immigrant rights, human rights, LGBTQ rights, criminal justice, or experience working with trauma survivors is a plus.
Experience with databases and data tracking (i.e., Legal Server) is a plus.
