No, an employer cannot require a Covid vaccine in Florida. Governor DeSantis signed HB 1B into law, creating a new Florida Statute prohibiting private employers from using Covid-19 vaccination mandates.
This is the case unless the employer provides employees specific individual exemptions from the vaccine requirement, including:
A medical exemption for those whose physician, physician assistant, or advanced practice registered nurse provides a written exemption to the employee that states vaccination is not in the best medical interest of the employee
A religious exemption for those who refuse vaccination for legitimately held religious beliefs
A Covid-19 immunity exemption is made
A periodic testing exemption where the employee agrees to comply with a regular Covid testing policy
An employer-provided personal protective equipment exemption, where the employee agrees to wear employer-provided personal protective equipment in the presence of other employees, customers, clients, or other persons
