Administrator vs. Executor

An executor is someone who has been appointed by a person making their will to manage and distribute their estate after their passing, while an administrator is appointed by the court.

Executors have a number of duties, especially if the financial or family circumstances are complex. Typically an executor must find the deceased person's assets and manage them until they are distributed to the inheritors.

They must also determine if probate court proceedings are necessary. An executor is also responsible for paying debts, taxes, and supervising the distribution of property.

An administrator has been appointed by the court and one the court has issued the grant of administration, this person or entity becomes the executor and has the same duties as described above.

While the overall duties are the same, there are differences between an executor and an administrator. The key differences are:

  • An executor is someone who was nominated in the will itself to be in charge of the estate

  • An administrator is someone who is appointed by the court to be in charge of an estate when a person died without a will or without a named executor.

  • The person most closely related to the person who died has the biggest preference in being appointed the administrator of their estate whereas a named executor does not have to be a relative

  • There are additional checks required for someone applying to be the administrator of a will whereas an executor essentially only has to confirm their appointment. For example, someone applying to be the administrator may be required to show how they are related to the decedent to prove they are the closest living relative and/or obtain consent from other relatives that are at the same level as the applicant.
